History

The Custody Review Board was established in 1985 under the Child and Family Services Act. Section 96 of the Child and Family Services Act provides for the establishment of the Board. The Lieutenant Governor in Council appointed a part-time Chair and part-time Board members to hear applications and make recommendations to Provincial Directors regarding custodial placement of youth in conflict with the law.  Legislative authority is set out in the Child and Family Services Act and the Youth Criminal Justice Act. The Board conducts reviews of:

  • A decision about a particular placement where a young person is being held, or to which the young person has been transferred;
  • A young person’s transfer from a place of open custody to a place of secure custody;
  • A refusal to authorize the young person’s temporary release or reintegration leave.

In 1999 one part-time Chair was appointed to lead both the Child and Family Services Review Board and Custody Review Boards. Part-time Board members were cross-appointed to both Boards.

In 2006, a full-time Chair and two full-time Vice Chairs were appointed to both Boards.
